Prior Informed Consent substances

Prior Informed Consent is require to import or export certain substances, whether they are sold as-is or in mixtures, under the Rotterdam Convention, http://www.pic.int/.

It is regulated in the EU through Regulation (EU) 649/2012, http://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:32012R0649&from=EN .

The PIC Regulation contains three sets of provisions linked to the export of chemicals:

  • Chemicals listed in Annex I are subject to the export notification procedure (Part 1) and to the explicit consent requirement (Parts 2 and 3). This list is updated regularly as result of regulatory actions under EU legislation, and developments under the Rotterdam Convention.
  • Chemicals listed in Annex V are banned for export.
  • All chemicals that are exported have to comply with rules on packaging and labelling pursuant to the CLP Regulation (EC) 1272/2008 or any other relevant EU legislation.
